Die Aufforderung beruht weitestgehend auf Grundlage des Gutachtens der AGES.<\/p>\n<p>Die Aufforderung des Aufsichtsorgans muss schriftlich erfolgen und kann eine Umsetzungsfrist enthalten. Die Frist und der Inhalt der Aufforderung h\u00e4ngen vom jeweiligen vorgeworfenen Versto\u00df ab.<\/p>\n<p>Falls der Aufforderung nicht Folge geleistet wird, leitet der Landeshauptmann ein entsprechendes Verfahren ein und \u00a0ordnet entsprechendes mittels Bescheides an.<\/p>\n<h2>R\u00fcckruf mittels Bescheids<\/h2>\n<p>In der Regel hat der Landeshauptmann bei Wahrnehmungen von Verst\u00f6\u00dfen gegen lebensmittelrechtliche Vorschriften, Ma\u00dfnahmen mittels Bescheids, die zur M\u00e4ngelbehebungen beitragen, anzuordnen. Bei seiner Entscheidung hat dieser einen weiten Ermessensspielraum, was allerdings berechtigterweise zu kritisieren ist.<\/p>\n<p>Die M\u00e4ngelbehebung oder Risikominderung muss in einem angemessenen Verh\u00e4ltnis zur Schwere des Versto\u00dfes stehen. Diese Personen sind namentlich bekannt, eine Gef\u00e4hrdung dar\u00fcber hinaus w\u00e4re nicht zu erwarten \u2013 eine allgemeine Information der \u00d6ffentlichkeit ist nicht erforderlich!<\/em><\/div><\/div><\/div>[vc_column_text item_animation=&#8220;transition.fadeIn&#8220; css=&#8220;.vc_custom_1583265802536{margin-top: 18px !important;}&#8220;]Au\u00dferdem ist eine Information an die \u00d6ffentlichkeit durch das Bundesministerium nur zul\u00e4ssig, wenn die vom Unternehmen gesetzten Ma\u00dfnahmen nicht ausreichen, die Sicherheit der Verbraucher wiederherzustellen.<\/p>\n<p>Nach der Risikobewertung \u2013 noch vor Ver\u00f6ffentlichung \u2013 hat daher der BM Ma\u00dfnahmen des betroffenen Unternehmens zu ber\u00fccksichtigen. Wenn sich daraus ergibt, dass eine Gef\u00e4hrdung weggefallen ist, kann eine Ver\u00f6ffentlichung unterbleiben oder wenn Sie als Lebensmittelunternehmer selbst die \u00d6ffentlichkeit zeitgerecht informiert haben.<\/p>\n<p>Die Information an die \u00d6ffentlichkeit muss zudem den Inhalt aufweisen, dass die Warnung nicht besagt, dass die Gesundheitssch\u00e4dlichkeit der Ware vom Erzeuger (Importeur, Vertreiber) verursacht worden ist.<\/p>\n<p>Die \u00dcberpr\u00fcfung der Richtigkeit der Aussage bzw die Rechtm\u00e4\u00dfigkeit der Ver\u00f6ffentlichung durch das Bundesministerium kann nicht mittels eines ordentlichen Rechtsmittel \u00fcberpr\u00fcft werden. Es bleibt nur das Amtshaftungsverfahren.
